It is imperative that if you are setting up a health and welfare service, you have to register with the CQC before engaging in any regulated activity. The legal requirement is that any individual, partnership or organization must be registered with the CQC if they provide a regulated business in England. Any person (individual, partnership or organisation) who is interested in providing a regulated activity in England must be registered with CQC, otherwise it will be an offence.
There are 14 regulated businesses and suppliers are required to check if the business they want to do is currently regulated by CQC and therefore needs a CQC Registration before offering that business. When registering a service, the applicant is required to check what regulated activities they can provide and include them in the application.

There are certain parts of your service that the health authority will review before issuing a CQC registration certificate. Initially, when you initiate a service registration with CQC, the Service Quality Commission will arrange an initial interview to ensure that you can provide services in accordance with the rules or regulated business. To set up your own health or social care providers, such as a nursing home or home care agency, you must first register with the Quality of Care Commission (CQC).
Buyers and sellers of NHS practices should be aware that they will have to go through the CQC registration process twice. The second question (to be asked after the sale is completed) is the deregistration of the partnership and the registration of the buyer as a new dental provider. Again, it is worth noting that NHS England will not accept NHS contract transfer notice from the partnership to the Buyer until it has received written confirmation from CQC that the Buyer will be registered with the firm as the new supplier.
It is important to provide CQC with reasonable assurance of your future compliance, especially before any final registration decision is made. Once you apply, CQC advises that it will take 10 weeks to process your application before you respond to a service interview and an interview with a suitable person for a manager position. Before rejecting an application, the CQC must issue an offer notice stating the reasons for the proposed rejection of registration. CQC has the right to refuse registration under section 12 of the Health and Social Assistance Act 2008.
Under Article 12 of the Health and Social Assistance Act 2008, the CQC has the right to reject an application for registration if it is satisfied that “the requirements of the rules of Article 20 and the requirements of any other act appearing in the CC are relevant are not and will not be observed (if applicable) in relation to the implementation of regulated activities”. Often the CQC will issue an NoP because it is not satisfied with meeting certain requirements of the Health and Welfare Act.
CQC may reject registration applications during initial checks before they are submitted to the registration inspector for evaluation. This process is called verification and is usually completed within five business days of receiving the CQC. In such cases, CQC will usually return the application and attach the appropriate forms, which you must complete and return. This means that once you click Submit for a vendor application.
